DEBATE: Does the Supreme Court have Too Much Power?

The incoming Netanyahu government’s intention to enact reforms of the legal systems to limit the powers of the Supreme Court has stirred up a lot of controversies. In this week’s episode of the “Caroline Glick Show,” I hosted a debate between two eminent jurists – Harvard’s Professor Alan Dershowitz and Bar Ilan’s Professor Avi Bell.

While the two law professors disagree about the scope of the reforms required, they both agree that the power of the Court should be limited.

At a time when the left in Israel and its supporters around the world are using the incoming government’s intention to curb the currently unlimited powers of Israel’s Supreme Court and legal system more generally, the debate between Dershowitz and Bell was a refreshing demonstration that it is possible to discuss this critical issue in a rational manner and that it is also possible to use deliberation to reach agreements. Obviously, unanimity is impossible and undesirable, but no one needs to lose their heads over the issue, which is about the desirable division of powers between competing branches of government and the role of the people in determining the course of their nation.
