YouTube silences Latma, removes We Con the World

As Israel went offline for the Jewish sabbath, YouTube removed most versions of Latma’s hit parody song We Con the World. If you try to access the song on YouTube you receive the notification:

 

This video is no longer available due to a copyright claim by Warner/ Chappell Music, Inc. .

 

Copyright experts we advised with before posting the song told us in no uncertain terms that we were within our rights to use the song because we did so in accordance with the Fair Use Doctrine. The Fair Use Doctrine, copied and pasted below from the US Copyright Office stipulates that it is legal and permissible to use copyrighted material under the fair use doctrine for purposes of parody. 

 

Copyright attorneys also warned us that given our clearly lawful use of the song We are the World, if anyone wished to silence our voices, they wouldn’t target us. Instead they would target YouTube. It is YouTube’s standard practice to remove any material that they receive even the flimsiest threat for because the company wishes to avoid all litigation.
 
At the same time, this is not YouTube’s first move to silence Israeli voices. During Operation Cast Lead, the IDF Spokesman’s Unit established a YouTube channel and began posting combat footage on its channel to bypass the anti-Israel media and go directly to news consumers. 
Shortly after the IDF channel began making waves, YouTube – which is owned by Google – removed IDF videos from the website. After the move evoked a storm of protest, YouTube restored them but flagged the videos in the same manner it flags pornography. People trying to access the videos received a screen saying, “This video or group may contain content that is inappropriate for some users, as flagged by YouTube’s user community. To view this video or group please verify that you are 18 or older by singing in and signing up.”

If YouTube didn’t already have a track record for censoring pro-Israel material, I would say that despite the obviously frivolous and unsubstantiated nature of the copyright claim against We Con the World, the company was simply erring on the side of caution. 

 

The fact that more than 3 million people have already seen the video and that it has been written up in major newspapers and featured on major television networks around the world since we first posted it last Thursday night however causes me to fear that something else is going on here. 

 

Despite these obstacles, we at Latma have no intention of crying Uncle. By tomorrow, we will repost our song on blogs throughout the world. If you already downloaded the song, please post it on your website. If not, I will post a non-youtube version on my site tomorrow with instructions from my webmaster about how to download it. 

 

Moreover, stay tuned for our next video next Thursday night. 

 

If someone is in fact trying to silence our voices, they will soon discover that they are messing with the wrong Jews. 

 

Here’s that Fair Use Doctrine from the US Copyright Office 

 

One of the rights accorded to the owner of copyright is the right to reproduce or to authorize others to reproduce the work in copies or phonorecords. This right is subject to certain limitations found in sections 107 through 118 of the copyright law (title 17, U. S. Code). One of the more important limitations is the doctrine of “fair use.” The doctrine of fair use has developed through a substantial number of court decisions over the years and has been codified in section 107 of the copyright law.
Section 107 contains a list of the various purposes for which the reproduction of a particular work may be considered fair, such as criticism, comment, news reporting, teaching, scholarship, and research. Section 107 also sets out four factors to be considered in determining whether or not a particular use is fair:
1. The purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes
2. The nature of the copyrighted work
3. The amount and substantiality of the portion used in relation to the copyrighted work as a whole
4. The effect of the use upon the potential market for, or value of, the copyrighted work
The distinction between fair use and infringement may be unclear and not easily defined. There is no specific number of words, lines, or notes that may safely be taken without permission.
Acknowledging the source of the copyrighted material does not substitute for obtaining permission.
The 1961 Report of the Register of Copyrights on the General Revision of the U.S. Copyright Law cites examples of activities that courts have regarded as fair use: “quotation of excerpts in a review or criticism for purposes of illustration or comment; quotation of short passages in a scholarly or technical work, for illustration or clarification of the author’s observations; use in a parody of some of the content of the work parodied; summary of an address or article, with brief quotations, in a news report; reproduction by a library of a portion of a work to replace part of a damaged copy; reproduction by a teacher or student of a small part of a work to illustrate a lesson; reproduction of a work in legislative or judicial proceedings or reports; incidental and fortuitous reproduction, in a newsreel or broadcast, of a work located in the scene of an event being reported.”
Copyright protects the particular way an author has expressed himself. It does not extend to any ideas, systems, or factual information conveyed in the work.
The safest course is always to get permission from the copyright owner before using copyrighted material. The Copyright Office cannot give this permission.
When it is impracticable to obtain permission, use of copyrighted material should be avoided unless the doctrine of fair use would clearly apply to the situation. The Copyright Office can neither determine if a certain use may be considered fair nor advise on possible copyright violations. If there is any doubt, it is advisable to consult an attorney.

What surprised me is that they actually had posted an Israeli flag on Independence Day in their moniker. I guess they have to make up for that mistake and take down as much truth concerning Israel as possible.

    Since this is indeed not the first time I really think it is time to;
    a) create a ‘zion(ist) proof’ youtube platform,
    b) make use of it.
    Simply copy the layout/user experience of youtube and make sure the whole thing is hosted and owned in Israel.

    Iam not surprised by utube’s actions – they panic very easily when -as has obviously happened here- they are besieged by countless emails,telephone calls from hordes of anti-semites,the gullible and loud left and the supporters of Islamic hate.     The original song has been parodied numerous times since its release in the 1980s, and You Tube continues to broadcast many of these other parodies.
    For example:

    Well, the song unmasks Israel’s enemies. They are furious and can’t bear that. Just as the song says: they want to go on pretending to be for justice and human rights. Apart from that, Evil has no sense for humour. Evil likes scorn and derision, but never humour.

    The US Supreme Court has given great allowances for parody. In Campbell v. Acuff-Rose Music (1994), Justice Souter wrote for the SC:
    The fourth fair use factor is “the effect of the use upon the potential market for or value of the copyrighted work.” It requires courts to consider not only the extent of market harm caused by the particular actions of the alleged infringer, but also “whether unrestricted and widespread conduct of the sort engaged in by the defendant . . . would result in a substantially adverse impact on the potential market” for the original. The enquiry “must take account not only of harm to the original but also of harm to the market for derivative works.”

    YouTube’s reaction is proof of it.
    Pro-Israel video satire must be supported and expanded. There is a lot of creative talent in Israel. I’m sure this project will get bigger and better.
    Caroline, unfortunately the YouTube and Facebook generation does not read much. They get their facts and news, if at all, from “alternative” websites. And their “progressive” teachers and professors make sure they get only their version of facts and history. So give them something they feel comfortable with: humor, pictures, basic ideas they can grasp.
    The ones that deserve the brunt of Latma’s satire right now are the Do-gooders. The fanatics are a hopeless case. But Do-gooders are very sensitive to ridicule, once you show them they’ve been duped.
    One topic that should be at the top is Do-gooders double standard, their obsessive concern with the overfed Gazans (who until now could not get cookies with their foreign aid, the poor things), while they remain indifferent to people in Africa being starved, raped, tortured and murdered.
    Caroline, almost all the Pro-Palestinian PR ideas, organization and activism in the West come from Leftists funded by Western Do-Gooders (many of them Jewish!).

    So, to recap…someone posts a parody on YouTube. YouTube then receives a copyright notice, presumably under the DMCA, and does what YouTube does pretty much every time it receives a DMCA notice — it takes the video down.
    *Yawn*
    Under the DMCA then the party that has the video removed can issue a counternotification. Unless the claim here is that YouTube didn’t allow a counternotification to be filed or refused to restore it after the counternotification, the post here is nonsense.
    And the real problem is the DMCA which really needs to be repealed to stop nonsense like this from happening in the first place.

    The problem might not be with the parody but the use of the actual music from “We Are the World,” which is under copyright.
    I posted a parody of Jefferson Starship’s “White Rabbit” in which Barack Obama, clearly on mind-altering drugs, envisions a world without nuclear weapons. The lyrics are similar to those of “White Rabbit,” which I understand to be legitimate (sometimes known as “filking,” or making a folk song similar to a popular music piece) but I did not include the music itself. So far, no problems or complaints.
    The Kinsey Sicks did a piece called “We Arm the World” (also performed by the Capitol Steps), and the Capitol Steps has a piece called “Dutch the Magic Reagan” (to the tune of “Puff the Magic Dragon”). It’s possible, though, that they actually licensed the music from the copyright owners noting the motive for profit.
    If someone wants to do a musical parody of the Gaza Flotilla, there IS plenty of music in the public domain due to age–Gilbert and Sullivan come to mind–that can be used freely.

    Current notice on Youtube says:
    “due to a copyright claim by Warner/Chappel Music”.
    Is there really such a claim? If there is, then main target for criticism should be Warner—for applying frivolous litigation against this particular parody of their IP while ignoring countless others.
    Of course Google/Youtube is still accountable for chickening out and not recognizing this claim for what it is.

    Thank you caroline,many comments on here are saying that they are Jewish now. I have also melded into a Jewish person over the last few decades. It would seem that an episode that occurs regularly every fifty or so years, of its the Jews fault punish them time.
    However you will also find this time around a huge support from the usually silent majority of gentiles. We are getting some what p#ssed off, by not only the moon god worshippers, but our own PC leftist apologists for the moon god worshippers.
    A breeze is stirring in the West, that is growing stronger, European countries have a ground swell of reaction in their own countries against the same darkness Israel faces every day.
    Modern communications are spreading the truth of the horror and evils committed by these moon god followers. People are seeing and hearing the truth of the debasement of human rights, child brides, genital mutilation, the stoning of women who have been raped [their fault] not. The hanging of young children,the odd beheading, this is a barbaric facist political system, not a religion.
    I do believe that the vast majority of people in free countries support you, wether they be christian, buddist, hindi or calathumpian.     Instead of jumping to conclusions, if further investigation was made you would find out that the publicity surrounding the video “alerted” the “Jackson Family” to Latma”s parody and “The Jackson family made application to have the video removed as it wasn’t in the spirit of the original song” and if “Michael was alive he would be “most upset” about this use of his music. “The video on Youtube can only damage memory of our son The King of Pop Michael Jackson”.

    Your video is a “Parody” and is in no way in violation of any copyright use.
    in a case involving 2 Live Crew’s parody of “Oh Pretty Woman” by Roy Orbison, the U.S. Supreme Court ruled that parodies can be a “fair use” of an original song, requiring no permission or royalties. One of the main points the Supreme Court made was that when a parodist significantly changes the words and meaning of an original song to spoof it, the parody becomes a new work — even if it uses the music of the original. And that to do a parody of a song, you need to use at least some of the music of the original to “conjure up” the original. You can’t have a parody without having elements of the original in that parody.

    Actually, Youtube says that YOU removed it yourselves. When I clicked on my link to it just now, the message there says “This video has been removed by the user.” Now they’re blaming you for their actions!

    Great video! I have been sharing it with as many of my family that I can. I just finished sharing it with two young people and have had the opportunity to explain the situation with Israel, terrorists, and the media( I think there is a difference between the last two…or is there?). Shalom

    It definitely OUGHT to be considered fair use, and its an outrage that it was taken down. But so-called legal experts who claim with absolute certainty that it IS fair use are leading you astray for ideological reasons. (Again, I sympathize and support those ideological reasons, but that doesn’t justify failing to provide you with an objective legal analysis.)
    The fact of the matter is that the U.S. Supreme Court does not give “great allowances” for parody – but rather narrow and vaguely defined allowances which lower courts continue to struggle over.
    I’d recommend that you read the Penguin Books v. Dr. Seuss case to give you an example:

    That case above cited the “2 Live Crew” Supreme Court case to help rule that a Dr. Suess parody was NOT protected as fair use. The Supreme Court didn’t clarify fair use with that case, it only muddied the waters even further.
    In fact, citing the fair use statute is pretty much an exercise in futility, since both sides of the copyright debate use it for their own ends. For real world, practical purposes, its not the statute which defines fair use, its judicial proclamations which are handled on a case-by-case basis, making concrete determinations of fair use nearly impossible to determine ahead of time.
    I’ll lend my voice to help keep the ‘We Con The World’ video up – but proclamations that this is “definitely” fair use are ultimately political statements, not serious legal analysis.

    I was shocked when 3 days ago i went to yt to listen the song…and the over 2,500,000 Video was gone! Gone!!! saying it had a copy right trouble involved…i was shocked! Then i was thinking…how come other people can make parody of all kinds of things let alone music…and it was never rejected by youtube,
    so i knew there was something wrong…with youtube …not the copy right.
    Go for it Caroline, we will help you, support you guys, to put the song everywhere…this one, and others your choir bring forth.

    First – thanks for the song satire – it’s very to the point.
    The removal story sounds strange. It smells political. Google is usually not too eager to yield to copyright claims without a base. However there are different situations. Some are covered here: http://www.chillingeffects.org this group can also probably help in reviewing whether it is really a copyright infringement or not.
    May be it’s possible to fight that back with Google, but it will require time and effort.

    I am not a Jew, but I like the video “We con the world” and I shared it with many on the facebook. This parody is the great idea how to share the truth. The international condemnation of Israel is clearly a case of “don’t confuse me with facts because my mind is already made up.” Shame on youtube.

    We are in the midst of an emergence of a new order — the battleground is the Information Network and the threat is the increasing sophistication of the Muslim propaganda machine; their exploitation of the news media and Internet; and the almost monolithic support they receive from radical-left academics, both here in America and abroad.
    Israel has finally wised up and begun to use the Internet as a channel for presenting hard facts (for example, the actual camera footage of the preparations onboard the flotilla ship to attack the Israelis with steel bars and knives, and the initial clubbing and stabbing attacks on the Israelis as they dropped onto the deck), to counter the propaganda onslaught. Israeli artists are even starting to nurture a following with creative and poignant videos such as We Con the World.
    Bowing to overwhelming anti-Semitic pressure, YouTube censored the original posting, feebly hiding behind a “copyright issue” with Warner/Chappell. But the obvious parody clearly falls under the Fair Use Doctrine, and YouTube is well aware of this. Considering that most of the millions of videos posted on YouTube contain blatant copyright infringements, it’s amazing that this one video would be singled out for censorship.
    As Nazi Germany and its Goebbels propaganda machine horribly demonstrated, otherwise rational and reasonable minds can be twisted by even a few craftily constructed films and posters — the Internet is far more pervasive and potentially far more persuasive than anything the Nazis had at their disposal. We need to counter the onslaught of venomous hype with profound reality and enlightening clarity. Will the plain and simple truth prevail? Only if we make the effort to join in the emerging but growing chorus countering the lies.

    Latma’s lawyers’ legal advice was 100% correct. The Supreme Court held long ago in Campbell v. Acuff-Rose Music (92-1292), 510 U.S. 569 (1994) that songs like We Con the World are absolutely fair use and protected under the First Amendment. And Rush Limbaugh’s parodies by Paul Shanklin (like Barack the Magic Negro) are equally protected. YouTube is a censor for the Left. If anyone still airing We Con the World were to get sued, it would go all the way to the Supreme Court and barring any more stupid appointments of amateur liberals by Obama, the Leftist proprietors of We Are the World would fail.

    Caroline-just so you know I looked all over for the Flotilla Choir they even zapped it from breitbart.tv. It’s my new favorite song-it is Monday afternoon here in America so it can’t be Sabbath in Israel-I’m Catholic so I’m afraid I might be a little wrong on time, but not in this case. Three million hits in a couple of days, that has got to be some record, also everyone LOVES the Flotilla Choir except for some real mean low down skunks with God forbid no sense and no sense of humor.
    Great job Flotilla Choir. I can’t wait until somebody finds and reposts.

    Don’t give up the fight, but don’t fret too much either: the damage is already done. That song is hopelessly stuck in my head. I find myself singing snippets on the bus. (To the strange looks from Keffiyeh wearing useful idiots.) The seeds of future parodies have been planted!

    I would never have expected Israel to be made a scapegoat of in my home town, by educated people – even friends! That poison has seeped into the brains of friends of mine. What a sad time. And I had such high hopes of human nature.

    Dear Caroline! No doubt that millions of people support you. Youtube are cowards, it is known to everybody. Mostly they are afraid of arabs’ reaction. The same story was with Wilders’ movie. But they didn’t gain anything. Your parody is great. Real art of parody!
    And that is real hasbara.
    We often use your videos in our community that we created in support of Israel during Cast Lead. We also have mirrors in some other resources, we write in russian but people translate various materials into English, French, German, Hebrew etc.
    When your video was removed by youtube, it was immidiately released in RuTube.:)
